To make sure this happens, we use technology to learn what you like and want. While we think our sites, apps, and point-of-sale systems are pretty cool, we also understand that you need to protect your privacy. We take that seriously.

This policy is intended to help you understand what information we collect from you, how we collect it, and what we do with it. If it's not right for you, you don't have to use our services. 1. Who We Are.

Welcome to Tixify!

This Privacy Policy cover the personal information we collect about you when you use our products or services, whether that be on-site at an event, or on one of our websites. which we refer to as “Services” or "Tixify Properties" in this policy. “Tixify”, “We”, "Us" and “Our” refers to Tixify Limited, and any of our corporate affiliates.

This policy also explains your choices about how we use personal information about you. Your choices include how you can object to certain uses of information about you and how you can access and update certain information about you. By accessing any of our Services, you provide consent to the collection and use of the information about you. If you do not agree with this policy, do not access or use our Services or interact with any other aspect of our business.

If you have any questions about this Privacy Policy or how we manage your personal information, please contact our Privacy Officer.

We may update or revise this Privacy Policy from time to time. You can find the most current version on our legal terms website (https://legal.tixify.live) or by asking our Privacy Officer for a copy.

Who is Who.

When this Privacy Policy uses the term "Organizer" we mean event creators using the Services to power events for attendees using our Services

  • (a) to consume information about, or attend, events ("attendees"), or
  • (b) for any other reason.

Organizers, attendees and third parties using our Services are all referred to in these Terms collectively as "Users", "you" or "your". Tixify Limited is a United States corporation with its principal place of business at 447 Broadway, 2nd Floor Suite #1511, New York, New York 10013, United States ("Tixify," "us," "we" or "our"). If you are resident in the EEA or Switzerland, Tixify Limited is the responsible party with respect to Personal Data (defined below) collected through the Services.

2. Our Privacy Statement.

This Privacy Policy sets forth our policy with respect to information that can be associated with or which relates to a person and/or could be used to identify a person ("Personal Data") that is collected from Users on or through the Services.

"Non-Personal Data" as used in this Privacy Policy is therefore any information that does not relate to a person and/or cannot be used to identify a person.

When you interact with the Services, we may collect Non-Personal Data. The limitations and requirements in this Privacy Policy on our collection, use, disclosure, transfer and storage/retention of Personal Data do not apply to Non-Personal Data.

3. Personal Data That We Collect.

When you use or interact with us through the Services, we may collect Personal Data. Sometimes this will be on our own behalf and other times this will be on behalf of an Organizer using our Services to run an event.

This is an important distinction for purposes of certain data protection laws and is explained in more detail below.

3.1 Information Collected From All Users.

Information you provide to us:

For all Users we collect Personal Data when you voluntarily provide such information to the Services, such as when you register for access to the Services, contact us with inquiries, respond to one of our surveys or browse or use certain parts of the Services.

The Personal Data we may collect includes without limitation your name, address, email address and any other information that you choose to provide and/or that enables Users to be personally identified.

From time to time Tixify collects personal information about individuals who are not customers. This is usually where we collect the name and business contact details of a person who is the contact in a government agency or company with whom we deal. Tixify’s policy is to only use personal information collected from non-customers for the main business purpose for which it was collected.

Information we automatically collect:

We also automatically collect information about you when you use our Services, including browsing our websites and taking certain actions within the Services ("Automatic Data").

Your use of the Services: We keep track of certain information about you when you visit and interact with any of our Services. This information includes the features you use; the links you click on; the type, and how you interact with others on the Services.

Device and Connection Information: We collect information about your computer, phone, tablet, or other devices you use to access the Services. This device information includes your connection type and settings when you access, update, or use our Services. We also collect information through your device about your operating system, browser type, IP address, URLs of referring/exit pages, device identifiers, and crash data. We use your IP address and/or country preference in order to approximate your location to provide you with a better Service experience. How much of this information we collect depends on the type and settings of the device you use to access the Services.

Cookies and Other Tracking Technologies: Tixify and our third-party partners, such as our advertising and analytics partners, use cookies and other tracking technologies (e.g. pixels) to provide functionality and to recognize you across different Services and devices. For more information, please see our Cookies and Tracking Notice, which includes information on how to control or opt out of these cookies and tracking technologies.

When you register for the Services or otherwise submit Personal Data to us, we may associate other Non-Personal Data (including Non-Personal Data we collect from third parties) with your Personal Data. At such instance, we will treat any such combined data as your Personal Data until such time as it can no longer be associated with you or used to identify you.

3.2 Information Collected From Organizers.

If you are an Organizer we will collect additional Personal Data from you.

Information you provide to us:

In some cases, we may collect your credit card information (e.g., your credit card number and expiration date, billing address, etc.), some of which may constitute Personal Data, to secure certain payments.

In addition, if you use our payment processing services, we will collect financial information from you (e.g., your bank account information or an address to send checks) as necessary to facilitate payments and information required for tax purposes (e.g., your taxpayer identification number). Information we obtain from other sources:

We may also collect or receive Personal Data including your name, email address and other contact information from third party sources, such as third party websites and marketing partners, your bank, our payment processing partners and credit reporting agencies.

3.3 Information Collected From attendees.

If you are an attendee we will collect additional Personal Data from you, sometimes for our own purposes and other times on behalf of an Organizer (see Section 16 below for more information).

Generally, we collect personal information when you use one of our Services, such as one of the examples below:

  • your attendance at, or engagement at events that use our RFID wristbands to facilitate access control, cashless payment, social activations or lead capture solutions;
  • as part of the process of registering or purchasing tickets for an event
  • you access one of the Tixify Online Services, such as the pre-event top up, or refund portal for an event using our RFID wristbands;
  • indicate that you wish to receive news, offers or other marketing material from Tixify;
  • make an inquiry or a complaint;
  • visit one of our websites;
  • have other dealings with us, for example, via social media or in person, over the phone or when you write to us.

In certain circumstances, we may also collect personal information about you in the course of combining and analyzing different data sets which, in and of themselves, may not contain personal information.

Sometimes we collect personal information about you from other sources, for example:

  • through any of our related companies;
  • people registering for an account, or applying for a refund on your behalf;
  • our business clients such as venues and promoters; or
  • third party suppliers and contractors who assist us to operate our business, such as:
    • information technology suppliers
    • marketing and digital services suppliers
    • research and development organizations
    • data partners
    • analytics consultants; and
    • publicly available sources of information

Information you provide via Tixify Properties or Applications:

We collect information about you when you input it into the Services or otherwise provide it directly to us.

  • Account and Profile Information: We collect information about you when you register for an account, register or purchase tickets for an event, create or modify your profile, set preferences, sign-up for or make any other purchases through the Services. For example, you provide your contact information and, in some cases, billing information when you register for your online account and load funds to your event wristband. We keep track of your preferences when you select settings within the Services.
  • Content you provide through our websites: The Services also include our websites owned or operated by us. We collect other content that you submit to these websites, which include social media or social networking websites operated by us. For example, you provide content to us when you provide feedback or when you participate in any interactive features, surveys, contests, promotions, sweepstakes, activities or events.
  • Information you provide through our support channels: The Services also include our customer support, where you may choose to submit information regarding a problem you are experiencing with a Service. Whether you designate yourself as a technical contact, open a support ticket, speak to one of our representatives directly or otherwise engage with our support team, you will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.
  • Payment Information: We collect certain payment and billing information when you use certain sections of the Services. For example, when you purchase tickets to an event or pre-load funds to your event wristband, you provide payment information, such as payment card details, which we collect via secure payment processing services.

When you register for, or otherwise provide information to Tixify in conjunction with an Organizer event or activity, whether that information is yours or a third party’s, in connection with a purchase, registration, or transfer, that Organizer will receive and may use the information you provide.

Please see Section 5.5 below, titled “How We Disclose and Transfer Your Personal Data: Organizers” for more information about an Organizer’s receipt and use of your Personal Data.

Organizers can set up additional profile fields to collect virtually any information from attendees in connection with registration for an Organizer's event powered by the Services.

Tixify does not control an Organizer's registration process nor the Personal Data that they collect.

Information we obtain from other sources:

We may also collect or receive Personal Data from third party sources, such as Organizers, business and channel partners, other attendees, social media or other third party integrations, your credit card issuing bank, our payment processing partners or other third parties.

Other services you link to your account:

We receive information about you when you or your administrator integrate or link a third-party service with our Services. For example, if you create an account or log into the Services using your Facebook credentials, we receive your name and email address as permitted by your Facebook profile settings in order to authenticate you. You may also integrate our Services with other services you use, such as to allow you to access, store, share and edit certain content from a third-party through our Services. For example, you may authorize our Services to access, display and store files from your social media accounts. The information we receive when you link or integrate our Services with a third-party service depends on the settings, permissions and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in these third-party services to understand what data may be disclosed to us or shared with our Services.

Tixify and Related Companies:

We receive information about you from companies that are owned or operated by Tixify, in accordance with their terms and policies.

Tixify Partners:

We receive information about you and your activities on and off the Services from third-party partners, such as advertising and market research partners who provide us with information about your interest in and engagement with, our Services and online advertisements.

4. How We Use Your Personal Data.

We collect and use the Personal Data we collect in a manner that is consistent with this Privacy Policy, and applicable privacy laws. We may use the Personal Data as follows:

4.1 Specific Reason.

If you provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided. For instance, if you contact us by email, we will use the Personal Data you provide to answer your question or resolve your problem and will respond to the email address from which the contact came.

4.2 To Provide the Services.

If you provide Personal Data in order to obtain access to or use of the Services or any functionality thereof, such as our RFID wristbands and technology, we will use your Personal Data to provide you with access to or use of the Services or functionality and to analyze your use of such Services or functionality. For instance, if you supply Personal Data relating to your identity or qualifications to use certain portions of the Services, we will use that information to make a decision as to granting you access to use such Services and to assess your ongoing qualification to use such Services.

4.3 For Research and Development.

We are always looking for ways to make our Services smarter, faster, secure, integrated, and useful to you. We use collective learnings about how people use our Services and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for integration and improvement of the Services. In some cases, we apply these learnings across our Services to improve and develop similar features or to better integrate the services you use.

4.4 To communicate with you about the Services.

We use your contact information to send transactional communications via email and within the Services. We also provide tailored communications based on your activity and interactions with us. These communications are part of the Services and in most cases you cannot opt out of them. If an opt out is available, you will find that option within the communication itself or in your account settings.

4.5 To market, promote and drive engagement with the Services.

We use your contact information and information about how you use the Services to send promotional communications that may be of specific interest to you, including by email and by displaying Tixify ads on other companies’ websites and applications, as well as on platforms like Facebook and Google. These communications are aimed at driving engagement and maximizing what you get out of the Services, including information about new features, newsletters, and events we think may be of interest to you. We also communicate with you about new product offers, promotions and contests. If you no longer want your Personal Data to be used for these purposes please contact us at [email protected].

In the case of an Organizer’s advertising, you may need to contact the Organizer directly. For more information about how we and Organizers market on, and interact with social media sites, please refer to section 5.6.

4.6 Customer support.

We use your information to resolve technical issues you may encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve the Services.

4.7 For safety and security.

We use information about you and your Service use to verify accounts and activity, to monitor suspicious or fraudulent activity and to identify violations of Service policies.

4.8 To protect our legitimate business interests and legal rights:

Where required by law or where we believe it is necessary to protect our legal rights, interests and the interests of others, we use information about you in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business.

4.9 Other Purposes.

If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time the Personal Data is collected or we will obtain your consent subsequent to such collection but prior to such use. For example, we may publish testimonials or featured customer stories to promote the Services, with your permission.

4.10 Aggregated Personal Data.

In an ongoing effort to understand and serve our Users better, we often conduct research on our customer demographics, interests and behavior based on Personal Data and other information that we have collected. This research is typically conducted on an aggregate basis only that does not identify you. Once Personal Data is in an aggregated form, for purposes of this Privacy Policy, it becomes Non-Personal Data.

5. How We Disclose And Transfer Your Personal Data.

We are not in the business of selling your Personal Data. We consider this information to be a vital part of our relationship with you. Therefore, we will not sell your Personal Data to third parties, including third party advertisers. There are certain circumstances in which we may disclose, transfer or share your Personal Data with certain third parties without further notice to you, as set forth in this Privacy Policy.

Business Transfers.

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets. We may also disclose your Personal Data in the course of due diligence for such an event. You acknowledge and agree that any successor to or acquirer of Tixify (or its assets) will continue to have the right to use your Personal Data and other information in accordance with the terms of this Privacy Policy.

Parent Companies, Subsidiaries and Affiliates.

We may also share your Personal Data with our parent companies, subsidiaries and/or affiliates for purposes consistent with this Privacy Policy. Our parent companies, subsidiaries and affiliates will be bound to maintain that Personal Data in accordance with this Privacy Policy.

Agents, Consultants and Service Providers.

We may share your Personal Data with our contractors and service providers who process Personal Data on behalf of Tixify to perform certain business-related functions. These companies include our marketing agencies, online advertising providers, data enhancement and data services providers, database service providers, backup and disaster recovery service providers, email service providers, payment processing partners, customer support, tech support, hosting companies and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.

Organizers.

In addition, when you register for an event, sign up for communications, enter a contest, or otherwise input your Personal Data (such as through a web form) to communicate with an Organizer or participate in an Organizer event, that Organizer will receive that information. For instance, if you input your name and email address into a web form for an Organizer offer, activity or event, the Organizer will receive that information. The Organizer may then send you marketing or other communications, which may be subject to its own, separate privacy policy. Likewise, if you provide your mobile phone number, you may receive information messages related to the service, event, activity or information in which you’ve expressed interest. When you purchase tickets to, register for or donate to an event, transfer an event ticket or registration to another person, enter a contest, or otherwise input your Personal Data (such as through a web form), or otherwise communicate with an Organizer, or participate in or express interest in an Organizer or Organizer event or activity, that Organizer will receive the information you provide, including your Personal Data, and where a ticket or registration is transferred, the Personal Data of the transferee as well. Other third parties that are involved in or on whose behalf an event or activity is promoted, may receive that Personal Data as well. For example, as to fundraising pages, we may provide your Personal Data both to the Organizer charity of the fundraising page and the Organizer of the event to which the fundraising page is linked. In some instances, an Organizer may appoint a third party, which may or may not be affiliated with the Organizer, to create an event or fundraising page on its behalf (we call these third parties ("Third Party Organizers"). For example, and without limitation, a concert venue (the Organizer, in this case) may allow third party promoters or production companies (the Third Party Organizers) to create events that will be hosted at the Organizer's venue using its Tixify account. In that case, we may provide your Personal Data to the Third Party Organizers on behalf of the Organizers. The same is true for contests and sweepstakes: we may provide your Personal Data to both the Organizer promoting the contest or sweepstakes, and any legal sponsor of the contest or sweepstakes (such as a brand sponsor). We are not responsible for the actions of these Organizers, or their Third Party Organizers (or other downstream recipients of your Personal Data), with respect to your Personal Data. It is important that you review the applicable policies of the Organizers, and if applicable and available, their appointed Third Party Organizers, of an event (and the related fundraising page, if applicable) before providing Personal Data or other information in connection with that event or related fundraising page. Similarly, if you are a member of an Organizer's organization within Tixify, your Personal Data will be available to the Organizer and shared with those Third Party Organizers granted permission by the Organizer to view all members of the Organizer's organization.

5.6 Facebook, Social Media and Other Third Party Connections.

a. Connecting Your Tixify Account to Social Media Services. You can connect your Tixify account to your accounts on third party services like Facebook, in which case we may collect, use, disclose, transfer and store/retain information relating to your account with such third party services in accordance with this Privacy Policy. For example, if you connect with Facebook, we store your Facebook id, first name, last name, email, location, friends list and profile picture and use them to connect with your Facebook account to provide certain functionality on the Services, like recommending events that your Facebook friends are interested in and sharing the events you are interested in, or attending, with certain groups of people like your Facebook friends.

b. “Liking” or “Following” Tixify on Social Media. In addition, when you “like” or “follow” us on Facebook, Instagram, Twitter or other social media sites (to the extent we provide that capability), we may collect some information from you including your name, email address, and any comments or content you post relevant to us. We likewise may collect your information if you sign up for one of our promotions or submit information to us through social media sites.

c. Facebook Plug-Ins and Links on Our Pages. Tixify’s own website may contain links to Facebook as well, such as through the Facebook “Like” or “Share” button or other social plug-ins. When you interact with these features and links, your browser will establish a direct link with the Facebook servers, and Facebook will receive information about your browser and activity, and may link it to your Facebook user account. For more information about how Facebook uses data, please see Facebook’s own policies.

d. Additional Facebook Marketing and Connectivity by Organizers. In addition, if you are a member of Facebook (or another social media platform), and you provide Personal Data to an Organizer (such as in the ways described in Section 5.5), the Organizer may use that Personal Data to send you advertising and offers through Facebook (or another social media) platform, including when you are on Facebook or another social media platform. The Organizer may use tool thats we provide and may also work with third parties to enable this data integration and advertising. Facebook and other social media platforms may provide a way to opt out of this type of advertising. Please review their user settings and support pages to learn more about how they help you to manage privacy and marketing choices.

e. Third party services and integrations. Tixify may provide you with opportunities to contract directly with third parties, and/or to integrate with third party services or applications, through our platform. In such instances, we will disclose your Personal Data to other entities in order to fulfill a request by you, or to provide services you have requested.

5.7 Legal Requirements.

We may disclose your Personal Data if required to do so by law in order to (for example) respond to a subpoena or request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of third parties, (c) prevent or investigate possible wrongdoing in connection with the Services, (d) act in urgent circumstances to protect the personal safety of Users of the Services or the public, or (e) protect against legal liability.

6. How We Store Your Personal Data.

We may store Personal Data itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the Personal Data collected via the Services from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration and destruction. However, no network, server, database or Internet or email transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any Personal Data.

7. How You Can Access, Update, Correct or Delete Your Personal Data.

You can access or delete your Personal Data stored by us. If you are a registered User, you can do this by logging in and visiting the Account Settings page to download a copy of your Personal Data in machine readable form and/or delete your Personal Data. You can also edit some of your Personal Data directly through your account. In certain cases, you can ask us to correct and update any inaccurate Personal Data using the contact information below, and we will consider your request in accordance with applicable laws. If an attendee initiates a data deletion request, Tixify is authorized to delete or anonymize Personal Data of the requesting attendee from the Services even if that means removing its availability to the Organizer through the Services. However, if you are an attendee, you understand that even if Tixify deletes or anonymizes your Personal Data upon your request or pursuant to this Policy, your Personal Data may still be available in the Organizer's own databases if transmitted to the Organizer prior to Tixify receiving or taking action on any deletion or anonymization activity. Unregistered Users and Ticketfly attendees may also access, update, correct or delete Personal Data and exercise these rights using the contact information below. We will consider and respond to all requests in accordance with applicable law.

8. How Long We Retain Your Personal Data.

We may retain your Personal Data as long as you are registered to use the Services. You may delete your account by visiting the Account Settings page. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.

9. Cookies, Pixels Tags, Local Shared Objects, Web Storage And Similar Technologies.

Please refer to our Cookie Statement for more information about our use of cookies and other similar tracking technologies.

10. Your Choices.

You have several choices available when it comes to your Personal Data:

10.1 Limit the Personal Data You Provide.

You can browse the Services without providing any Personal Data (other than Automatic Data to the extent it is considered Personal Data under applicable laws) or with limiting the Personal Data you provide. If you choose not to provide any Personal Data or limit the Personal Data you provide, you may not be able to use certain functionality of the Services. For instance, in order to buy tickets as an attendee, your name and email address will be required by the Organizer.

10.2 Opt Out from Electronic Communications.

(a) Tixify Marketing Communications. Where it is in accordance with your marketing preferences, Tixify may send you electronic communications marketing or advertising the Services themselves or events on the Services, to the extent you have registered for the Services or purchased a ticket and/or registration to an event listed on the Services. You can also "opt out" of receiving these electronic communications by clicking on the "Unsubscribe" link at the bottom of any such electronic communication. In addition, you may also manage your email preferences at any time by logging in (or signing up and then logging in), clicking on "Account" and then "Email Preferences."

(b) Organizer-initiated Communications. Organizers may use our email tools to send electronic communications to those on their email subscription lists, including attendees who have registered for their events on the Services in the past. Although these electronic communications are sent through our system, Tixify does not determine the content or the recipients of these electronic communications. Organizers are required to use our email tools only in accordance with all applicable laws. Tixify provides an "Unsubscribe" link on each of these emails, which allows recipients to "opt out" of electronic communications from the particular Organizer.

(c) Social Notifications. If you connect your Facebook account or sign up for other social media integrations whose product features include social notifications (i.e., updates on what your friends are doing on the Services), you will receive these social notifications. You can manage these social notifications by toggling your social settings to private or disconnecting such integration.

(d) Transactional or Responsive Communications. Certain electronic communications from Tixify are responsive to your requests. For instance, if you are an attendee, we must email you your ticket or registration on behalf of the Organizer when you purchase such ticket or registration. As a further example, if you email our customer support department, we will return your email. Notwithstanding any unsubscribe election that you have made, you will still receive these transactional or responsive emails. You can stop receiving these types of emails only by contacting us. By electing to stop receiving all electronic communications from us or through our system, you will no longer receive any updates on events you have created (including payout issues) or on events you are registered to attend (including emails with your tickets). We do not recommend that you do this unless you plan to no longer use the Services, are not currently registered for an event, are not currently organizing an event, and will have no need to receive further communications from us or through our system.

(e) Retention. It may take up to forty-eight (48) hours for us to process an unsubscribe request. Even after you opt out of all electronic communications, we will retain your Personal Data in accordance with this Privacy Policy, however, we will no longer use it to contact you. However, Organizers who have received your Personal Data in accordance with this Privacy Policy may still use that Personal Data to contact you in accordance with their own privacy policies, but they may not use our system to do so.

10.3 Do Not Track.

We currently do not participate in any "Do Not Track" frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your Personal Data.

11. Exclusions.

11.1 Personal Data Provided to Others.

This Privacy Policy does not apply to any Personal Data that you provide to another User or visitor through the Services or through any other means, including to Organizers on event pages or information posted by you to any public areas of the Services.

11.2 Third Party Links.

This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by us (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

12. Children - Children's Online Privacy Protection Act.

We do not knowingly collect Personal Data from children under the age of thirteen (13). If you are under the age of thirteen (13), please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Services without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to us through the Services, please contact us and we will endeavor to delete that information from our databases.

13. International Privacy Laws.

If you are visiting the Services from outside the United States, please be aware that you are sending information (including Personal Data) to the United States where our servers are located. That information may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by us. These countries (including the United States) may not necessarily have data protection laws as comprehensive or protective as those in your country of residence; however, our collection, storage and use of your Personal Data will at all times continue to be governed by this Privacy Policy.

14. Changes To This Privacy Policy.

The Services and our business may change from time to time. As a result, at times it may be necessary for us to make changes to this Privacy Policy. We reserve the right, in our sole discretion, to update or modify this Privacy Policy at any time (collectively, "Modifications"). Modifications to this Privacy Policy will be posted to the Site with a change to the "Updated" date at the top of this Privacy Policy. In certain circumstances Tixify may, but need not, provide you with additional notice of such Modifications, such as via email or with in-Service notifications. Modifications will be effective thirty (30) days following the "Updated" date or such other date as communicated in any other notice to you. Please review this policy periodically, and especially before you provide any Personal Data. This Privacy Policy was updated on the date indicated above. Your continued use of the Services following the effectiveness of any Modifications to this Privacy Policy constitutes acceptance of those Modifications. If any Modification to this Privacy Policy is not acceptable to you, you should cease accessing, browsing and otherwise using the Services.

15. Dispute Resolution.

16. EEA, SWITZERLAND AND UK ONLY - GDPR

The EU General Data Protection Regulation (GDPR) requires Tixify and Organizers using the Service to provide Users with more information about the processing of their Personal Data. Here is what you need to know:

16.1 Legal bases for processing (for EEA users):

If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal bases for doing so under applicable EU laws. The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where:

  • We need it to provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services;
  • It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Services and to protect our legal rights and interests;
  • You give us consent to do so for a specific purpose; or
  • We need to process your data to comply with a legal obligation.

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

As noted later in this policy this information will be shared and may be used by parent companies, subsidiaries and/or affiliates for purposes consistent with this policy.

From time to time, there may be other purposes for which we collect, hold, use and disclose your personal information. We will tell you about these at the point of collection.

16.2 Tixify as a data controller and a data processor

EU data protection law makes a distinction between organizations that process Personal Data for their own purposes (known as "data controllers") and organizations that process personal data on behalf of other organizations (known as "data processors"). If you have a question or complaint about how your Personal Data is handled, these should always be directed to the relevant data controller since they are the ones with primary responsibility for your Personal Data. Tixify may act as either a data controller or a data processor in respect of your Personal Data, depending on the circumstances. For example, if you create an account with us to organize your events, Tixify will be a data controller in respect of the Personal Data that you provide as part of your account. We will also be a data controller of the Personal Data that we have obtained about the use of the Applications or Tixify Properties, which could relate to Organizers or Consumers. We use this to conduct research and analysis to help better understand and serve Users of the Services as well as to improve our platform and provide you with more targeted recommendations about events we think may be of interest to you. However, if you register for an event as an Attendee, we will process your Personal Data to help administer that event on behalf of the Organizer (for example, sending confirmation, promotional and feedback emails, processing payments, etc.) and to help the Organizer target, and understand the success of, their event and event planning (for example, providing event reports, using analytics to gain insights into the effectiveness of various sales channels, etc.). In these circumstances, Tixify merely provides the tools for Organizers; Tixify does not decide what Personal Data to request on registration forms, nor is it responsible for the continued accuracy of any Personal Data provided. Any questions that you may have relating to your Personal Data and your rights under data protection law should therefore be directed to the Organizer as the data controller, not to Tixify.

17. How do we share the information that we collect?

We share information we collect about you in the ways discussed below, including in connection with possible business transfers, but we are not in the business of selling information about you to advertisers or other third parties.

Sharing with other Service users

When you use the Services, we share certain information about you with other Service users.

Managed accounts and administrators.

If you register or access the Services using an email address with a domain that is owned by your employer or organization, and such organization wishes to establish an account or site, certain information about you including your name, contact info, content and past use of your account may become accessible to that organization’s administrator and other Service users sharing the same domain. If you are an administrator for a particular site or group of users within the Services, we may share your contact information with current or past Service users, for the purpose of facilitating Service-related requests.

Community Forums.

Our websites offer publicly accessible blogs, such as the Tixify Blog. You should be aware that any information you provide on these websites – including profile information associated with the account you use to post the information – may be read, collected, and used by any member of the public who accesses these websites. Your posts and certain profile information may remain even after you terminate your account. We urge you to consider the sensitivity of any information you input into these Services. To request removal of your information from publicly accessible websites operated by us, please contact us. In some cases, we may not be able to remove your information, in which case we will let you know if we are unable to and why.

Sharing with third parties.

We share information with third parties that help us operate, provide, improve, integrate, customize, support and market our Services.

Service Providers.

We work with third-party service providers to provide website and application development, hosting, maintenance, backup, storage, virtual infrastructure, payment processing, analysis and other services for us, which may require them to access or use information about you. If a service provider needs to access information about you to perform services on our behalf, they do so under close instruction from us, including policies and procedures designed to protect your information.

Tixify Partners.

We work with third parties who provide consulting, sales, and technical services to deliver and implement customer solutions around the Services. We may share your information with these third parties in connection with their services, such as to assist with payments, to provide localised support, and to provide customizations. We may also share information with these third parties where you have agreed to that sharing.

Promoters, venue operators and sponsors:

We may disclose your personal information to any promoters, venue operators and sponsors of events for which you use the Services for operational purposes. If you consent, these organizations may use this information to provide you with promotional and marketing material about their events. You may update your preference to receive any promotional or marketing material at any time directly with the organizations which have obtained your information. If you do not have have their details, you can contact us directly. This privacy policy does not cover how these organizations use your information.

Third Party Apps.

Through your use of the Services, you may be explicitly asked to allow third-party apps to access your information. Doing so may give third-party apps access to your account and information about you like your name and email address, and any content you choose to use in connection with those apps. Third-party app policies and procedures are not controlled by us, and this privacy policy does not cover how third-party apps use your information. We encourage you to review the privacy policies of third parties before connecting to or using their applications or services to learn more about their privacy and information handling practices. If you object to information about you being shared with these third parties, you should decline when this is explicitly asked, however this may result in an inability to use the Services.

Social Media Widgets.

The Services may include links that direct you to other websites or services whose privacy practices may differ from ours. Your use of and any information you submit to any of those third-party sites is governed by their privacy policies, not this one.

Third-Party Widgets.

Some of our Services contain widgets and social media features, such as the Facebook ‘Share’ button. These widgets and features collect your IP address, which page you are visiting on the Services, and may set a cookie to enable the feature to function properly. Widgets and social media features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing it.

With your consent.

We share information about you with third parties when you give us consent to do so.

Compliance with Enforcement Requests and Applicable Laws; Enforcement of Our Rights.

In exceptional circumstances, we may share information about you with a third party if we believe that sharing is reasonably necessary to (a) comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements, (b) enforce our agreements, policies and terms of service, (c) protect the security or integrity of our products and services, (d) protect Tixify, our customers or the public from harm or illegal activities, or (e) respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person.

Sharing with affiliated companies.

We share information we collect with affiliated companies and, in some cases, with prospective affiliates. Affiliated companies are companies owned or operated by us. The protections of this privacy policy apply to the information we share in these circumstances.

Tixify and Related Companies.

We share information we have about you with other Tixify corporate affiliates in order to operate and improve products and services and to offer other Tixify affiliated services to you. This includes companies that own or operate the services listed here.

Business Transfers.

We may share or transfer information we collect under this privacy policy in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on the Services if a transaction takes place, as well as any choices you may have regarding your information.

18. How do we store and secure the personal we collect?

Tixify may hold your personal information in electronic or hard copy format or a combination of both. This personal information may be combined or linked with other information held about, or which we attribute to you.

We have taken a number of physical, electronic and procedural steps to protect your personal information from misuse, interference, loss, unauthorized access, modification or disclosure.

Information storage and security

Your personal information, even if collected within your home country, may be transferred to and stored in a country that is not the same as where it was collected on a temporary or permanent basis.

We protect the personal information we collect in a secure database stored by our third party data storage provider. Data collected online is stored in a two-step authenticated, encrypted private access only bucket. Tixify also employs firewalls, intrusion detection systems and virus scanning tools to protect against unauthorized persons and viruses from entering our systems.

Tixify employees are required, as a condition of their employment, to treat personal information held by Tixify as confidential, and to maintain the confidentiality of that personal information. They are also required to sign in and use a password when accessing Tixify systems, and are only granted access to parts of the system, or subsects of personal information, as required.

While we implement safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.

19. For Residents of California – California Consumer Privacy Act (CCPA)

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights. You have the right to request that Tixify disclose certain information to you about our collection and use of your personal information over the past 12 months. You can make this request by emailing [email protected]. Your request will be responded to within 45 days. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We only use personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • Our business or commercial purpose for collecting or selling that personal information.

20. How long we keep information

How long we keep information we collect about you depends on the type of information provided. After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.

However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.

Account information: We retain your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Services. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Services. Where we retain information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Services, not to specifically analyze personal characteristics about you.

Information you share on the Services: If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of the Services. For example, if you are a user who originally set up the Organization, we may retain your data as the original owner of that Organization.

Marketing information: If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our Services. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.

21. How to access and control the information we collect about you?

You have the right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format.

If you would like to access, correct or delete information we hold about you, or opt-out of communication, please contact us.

Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we or your administrator are permitted by law or have compelling legitimate interests to keep.
